Pirates have been around for as long as long-distance delivery has existed (mostly in boats on the ocean ... maybe Donald Trump will build a Space Force, but it'll probably be mostly to defend America against Richard Branson's Space-Pirates!
(or maybe Trump will be the one hiring Space Pirates, the way Queen Elizabeth used Sea-Pirates to help discover & colonize The Americas—often giving those pirates Knighthood in return!)
But–if the pirates aren't cleared by a government's officials (or if their 'government clearance' is disavowed like MIF)–the pirates are subject to execution no matter-what country they stole-from, -what country they're caught-in, or -what country caught them!
